A landlord in Frankfurt has won a court battle against his tenants who withheld their rent and complained about him visibly sunbathing naked in his courtyard.

A landlord in Frankfurt has won a case against his tenants who withheld their rent in protest after the landlord was seen regularly sunbathing nude in his courtyard, which was visible from the tenants’ offices.
While sweating it out in the upmarket offices of the human resources company, workers at the business became increasingly aggravated by their birthday-suit-bathing landlord. The company decided to withhold their rent due to their landlord’s penchant for nude sunbathing and other grievances, and the landlord sued.
Landlord never took the stairs naked, German court rules
In the state court on Wednesday, a Frankfurt judge ruled in favour of the landlord, stating that “the usability of the rented property was not impaired by the plaintiff sunning himself naked in the courtyard.”
While the court granted the tenants a reduced rent period to compensate for construction noises in the area, it ruled that since the tenants had not proven the landlord has gone down the stairs naked to the courtyard, and that he had “stated credibly that he always wore a bathrobe which he only took off just before the sun lounger”, withholding payment transfers had not been within their rental rights.
The court added that the landlord’s naked sunbathing didn’t have an “inadmissible, deliberately improper effect on the property” and that it was actually only possible to see the courtyard sunbathing spot by leaning far out of the office window.
